Terms and Conditions

This contract is between Melin Mabes = MM and the relevant individual making the booking on behalf of their Group (referred to as “you” or “your”). You shall ensure that all members of your Group comply with these Terms & Conditions. All bookings made are subject to these Terms & Conditions. Your booking will be confirmed once the deposit or any payment required under these Terms & Conditions has been received by MM in cleared funds. Any booking constitutes acceptance of our Terms & Conditions. You must be 18 years of age or over at the time of making this booking.

Payment

Payment of the full balance of the total cost of your stay is due 42 days before the date on which it is to commence. For bookings made less than 42 days before arrival, the full booking amount will be requested immediately to secure the booking. If payment fails to reach MM in accordance with these Terms & Conditions, MM will notify you and you will have seven days to complete the payment. If full payment is not received within seven days of the date of notification, MM reserves the right to cancel the booking and in order to pay for administrative costs and to compensate MM retain all deposits paid. All accommodation booked by you in these circumstances will immediately be publicly advertised as being available for re-hire.

Pre-authorisation charge – Security Deposit

We reserve the right to levy a pre-authorisation charge of up to £150 per unit on credit/debit cards. This pre-authorisation charge is in addition to the deposit. The pre-authorisation charge is required for the reimbursement to MM of any unusual costs which it may incur as a result of your stay, including without limitation: damage, breakages, exceptional cleaning costs, waste recycling sorting or delayed departure by you and housekeeper’s time accordingly. Guests should inform MM at the commencement of hire of any damage found on arrival. MM reserves the right to charge for any damage or missing items not reported by you on arrival. Should there be no reason for MM to retain the pre-authorised amount this will be released to you in full within 5 days of departure.

Cancellation By You

It may be necessary to cancel your stay due to illness, accident or change of circumstances. MM strongly advises visitors to take out full holiday insurance to cover cancellations, public liability and loss. As soon as you know that you need to cancel, please email us on melinmabes@gmail.com Cancellation charges are calculated from the date we receive your booking, in accordance with table below:

Deposit: 30% of the total booking fee.
Deposit payments are non-refundable and non-transferable in all circumstances. You agree that if you have not arrived by 8am on the morning after your stay was due to commence, or contacted MM to confirm your arrival, your stay with us will be deemed to be cancelled and the total cost will be forfeited to MM.

Cancellation By Us

In the event of MM having to cancel a booking for any reason whatsoever, its liability will be limited to all monies paid by you to MM in respect of that booking up to and including the date of cancellation. These monies shall be returned to you, as soon as possible, upon any such cancellation occurring. For clarity, in no event shall MM be liable for any special, indirect or consequential, costs, damages, charges or expenses incurred or suffered by you as a result of any such cancellation or for any of the following losses whether incurred directly or indirectly: pure economic loss, loss of business, goodwill, reputation or profits.

Cancellation Due to Exceptional Circumstances

MM will not be responsible for any cancellation due to exceptional circumstances such as acts of God, flood, pandemic, loss of power or any other circumstances outside the control of MM.

Travel Insurance

We strongly recommend that guests have their own travel insurance.

Termination of Stay

You are expected to maintain reasonable and appropriate standards of behaviour at all times whilst at Melin Mabes. MM have the right, at their sole discretion, to terminate your stay if you or members of your group are reasonably believed to be causing a nuisance to the other guests or are not treating the property with due respect. MM may require all or any such persons to leave the accommodation, without refund and in such an event, MM will not be liable for making any payment to you and in order to compensate MM for the nuisance caused will retain all monies paid by you.

Registration: All group members will need to be registered on arrival with a list of names and contact details.

Extra Guests: Only those guests originally booked are permitted to stay on site. Any extra guests will only be permitted on site at the site owner’s discretion. If extra guests are permitted to stay, then extra charges will be incurred. MM also needs to know about any day guests (ie. those not staying the night). They will also need to be registered.. MM may require all or any such persons to leave the accommodation, without refund and in such an event, MM will not be liable for making any payment to you and in order to compensate MM for the nuisance caused will retain all monies paid by you.

Refusal of Entry

MM reserves the right to refuse entry to any or all guests within the party if these Terms & Conditions are not observed. Any function, celebration, party, corporate event or ceremony must have the written permission of MM Any occupancy is for the purpose of a temporary holiday rental only and does not create the relationship of landlord and tenant between you and MM.

Care of the Property

During your stay you will take good care of your accommodation provided to you by MM On your departure, you agree to (a) leave your accommodation in the same condition of cleanliness and tidiness as at the commencement of your hire; (b) to pay for any loss or damage caused by you, during your occupation. Units must be secured (doors closed; fires extinguished, all lights and water turned off) upon departure. MM reserves the right to charge you for any loss, damage or extra cleaning to our property during or after your stay. All decorations, must be removed. Waste recycling should be disposed in the correct bins.

Limitation of Liability

MM accepts responsibility for those arrangements that are within its control but cannot accept liability for any injury, illness, loss or damage suffered by you or any member of your party unless one of the following applies:
• There was fraud or wilful default by us or our employees, or
• Death or personal injury was caused by the negligence of MM or our employees.
Please notify any shortcomings, complaints or dangerous items and potential hazards to us immediately so that they can be remedied. Claims may be reduced or rejected if we have not been given the opportunity to put matters right or investigate them.

Arrival and departure times

The hire period commences at 3pm on the first day of hire and terminates at 11am on the last day of hire. Check in is from 3pm till 8pm .Any significant delay in arrival should be notified to MM in order that arrangements can be made for entry into accommodation. Any significant delay in departure may incur a charge. Departures may be extended with the agreement of MM.

No Smoking Policy

Smoking is not allowed inside any unit and MM reserves the right to charge for costs of cleaning and redecoration if this provision is breached. Smoking is however allowed in the outside areas.

Pets

No pets are allowed at Melin Mabes unless agreed by the owners. An additional charge off £10 per pet per stay max two pets .Pets not allowed on any of the furniture or bedding . MM reserves the right to charge for costs of cleaning and redecoration if this provision is breached. Dogs: must be kept on a lead at all times whilst at Melin Mabes, and exercised in designated areas For the avoidance of doubt dogs must be kept on a lead whilst on the dog walk and dogs are not permitted in the toilet and shower blocks. Owners are required to clean up after their dogs, and dogs must not be left unattended at Melin Mabes. Dogs are not allowed free run in the Wildlife Haven area so as to preserve the stress free environment for the wildlife. Any customers seen to be allowing their dogs to foul the site without clearing it up will be asked to leave and their booking terminated without refund.

Children

Children must be under the supervision of their parents or guardians at all times. Children are not permitted in the adults only area of the site, please note there is open deep water in these areas. No children under the age of 16 are allowed in the toilet blocks unless accompanied by an adult.

Toilet block

Please ensure the door is kept closed and shoes removed outside and placed on shoe rack. Please ensure all taps are turned off before vacating. This is a shared block and therefore people from other units may use facility. Please wipe down floor and leave as you find it.Special consideration should be given to those less able please.

Hazards

There are a number of hazards at Meiln Mabes which include but are not limited to deep water a stream, banks, and rabbit holes. You will make sure all members of your party are aware of these hazards and take appropriate care when on site. The site is very dark at night, a torch should therefore be carried at all times.

Hot tub

Glassware must not be used in or around the hot tub. No food at all in or around hot tub please. Please shower and ensure feet are clean before entering the hot tub.Please ensure the lid is properly replaced and all jets turned off .Water temperatures between 34°C – 38°C are recommended.Bathers must not wear lotions, oils, makeup or skin creams in the spa pool.Bathers must not use the spa pool if they have had diarrhoea within the last 14 days.Bathers are discouraged from swallowing the spa pool water.It is recommended that bathers do not exceed 15 minutes immersion at a time.It is recommended that the spa pool is not used after a heavy meal or while under the influence of alcohol or sedatives.Intended users suffering from diseases of the heart and circulation, skin conditions, are immuno-suppressed, subject to fits, or taking drugs affecting the cardiovascular or nervous systems, should not use spa pools without first seeking medical advice. Pregnant women are advised to consult with their doctor before using a spa pool. Never use the hot tub while using or after using narcotics or other drugs that may cause sleepiness, drowsiness or raise/lower blood pressure.At 39-40°C limit your time in the hot tub to a maximum of 20 minutes as extending this time can affect your inner organs and cause fever like conditions. At 36-37°C this time can be extended as this is body temperature and there is no risk and can heighten the dangers of drowning due to suction below the water line.Never use the hot tub alone.Take care when entering and leaving the hot tub. When leaving the hot tub leg, muscles may be relaxed enough to make you unsteady. If any allergic reaction occurs leave the hot tub and rinse off in the shower. If the reaction persists, contact reception or go to a local doctor or A&E. Avoid using the hot tub immediately after a heavy meal. Avoid entering the hot tub water immediately after exercising as the water temperature can affect the heart rate. Take care on the decking/hot tub steps as water from the tub can cause it to be slippery. Parents are advised that the hot tubs are not suitable for children under the age of sixteen.

Noise

Noise from radios/engines etc. should be kept low with consideration for other users. Silence should be observed between 10:00pm and 7:00am. Strictly no fireworks, no guns of any kind. The releasing of sky lanterns with naked flames is not permitted in the locality.
Noise must be kept to a reasonable level at all times so as not to disturb the enjoyment of others.

Right of Entry

For the undertaking of necessary repairs, maintenance and/or inspections, MM has the right of entry to the property at all reasonable times. Prior notice will be given to you wherever possible and privacy will be respected at all times. MM or their appointed representatives reserves the right to carry out viewings at the property during the guest’s stay. At least 6 hours notice will be given to the guest wherever possible and disturbance will be kept to a minimum.

Complaints

MM want you to have an enjoyable stay. In the event of any problem arising on arrival or during your holiday, you should immediately bring this to the attention of MM or its representative and MM shall, at all times, endeavour to deal with any complaint or query promptly. MM regrets that claims for compensation cannot be considered after the holiday has ended if there was no such prior notification.

Lost Property

MM or its representatives will retain lost property items at their office premises for 28 days from the date of your departure. For items to be returned, MM reserves the right to charge a flat administration fee of £10.00 plus postage and packaging, payment for which is required in advance. MM does not accept responsibility for returning any items and will not return any food or drink left at Melin Mabes.

Delay or Failure to Perform

MM will not be liable to you if we are prevented or delayed in performing any of our obligations to you if this is due to any cause beyond MM’s reasonable control including (without limitation): an act of God, explosion, severe weather, flood, fire or accident; malicious damage; outbreak of disease; any form of government intervention or a third party act or omission.

Changing these Terms & Conditions

MM reserves the right to revise and amend these Terms & Conditions from time to time. You will be subject to the most recent Terms & Conditions in force at the time that you make your booking, unless any change is required to be made by law or if we notify you of the change to these Terms & Conditions before we confirm that your booking has been successful.

Data Protection

MM will only store and use the information you supply to us for the purposes of carrying out our contract with you, to collect valuable feedback about how satisfied you were with the services provided and from time to time to send information regarding special offers and promotions at Melin Mabes If you do not wish to receive feedback requests or promotional information please email us at melinmabes@gmail.com

Third Party Rights

These Terms & Conditions are made for the benefit of you and MM and is not intended to benefit any third party or be enforceable by any third party. The rights of you and MM to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to these Terms & Conditions are not subject to the consent of any third party.

Governing Law

These Terms & Conditions are governed by the law of England and Wales, and any dispute arising out of or in connection with these Terms & Conditions is subject to the exclusive jurisdiction of the courts of England and Wales.

Catering provided by Third Parties (i.e. Plum Vanilla, Team Curry)
All food delivered by Plum Vanilla will be kept cool in a fridge throughout your stay. 
The temperature of the food will be taken on delivery. Once delivered it is your responsibility to ensure the necessary precautions are taken to keep your food items cold. If you believe there is a problem with the items on delivery, please do notify Plum Vanilla immediately.
If you choose to use the fridge provided, please be sure to: 
Keep the door firmly closed when not in use. 
If you fail to follow this advice and you believe the quality/temperature of the food has been compromised, do not consume.

Pitch

Please give an expected arrival time so we can plan for your visit. If you are unexpectedly delayed on the day and expect to arrive after the last attended arrival time of 8pm please call the site before 8pm in order that the holiday site manager can discuss options; any requirements for disabled guests so that we can discuss these with you to check for availability and that the site can meet both your needs and expectations;Please familiarise yourself with the site’s fire regulations and fire-fighting equipment and its location as soon as you arrive on site. Prices are per pitch per night and include two adults. Pitches are available from 12 noon on the day of arrival, and must be vacated by 11:00 am on the day of departure. Late departures (until 5pm) may be available subject availability and an additional fee. The maximum pitch occupancy is six persons, we do not except group booking.Visitors, campers are welcome to have visitors, but they must report to reception and pay a visitor fee before entering the site. Please ensure you leave your pitch clean and tidy on departure.

This is a shared block and therefore guests from other units may use facility. Please wipe down floor and leave as you find it.Special consideration should be given to those less able please.

Electrical hook-ups

For customers requiring an electrical connection, you will need a 20m hook-up cable. If your unit is more than 20m from the nearest electrical point we will lend you an extension cable in return for a £20 deposit. Electric hook-ups are provided for use with camping accessories only, charging of electric vehicles is not permitted. A separate electric vehicle charge point is available. Portable heaters must not be used in awnings or tents at any time.

Vehicles

Caravans must be towed by a private car. We do not accept vans, commercial vehicles or any vehicles with sign writing. The maximum length of caravan accepted on site is 24 feet including tow hitch.

Noise

Noise from radios/engines etc. should be kept low with consideration for other users. Silence should be observed between 10:00pm and 7:00am. If returning to the campsite after 11:00 cars should be left in the car park.
– The use of threatening behaviour and/or foul and abusive language will not be tolerated and will result in the offender being asked to leave the site by a member of the holiday site team.
– Please consider other users of the site and we ask that all members of your party and any guests conduct themselves at all times with due regard to the health and safety of themselves and others.
It is important for Customers to respect and protect MM by holidaying in harmony with neighbours, the local community, the environment and by observing and respecting each other’s privacy. Maintaining high standards at Melin Mabes is of paramount importance and guests involvement is fundamental to our success and the conservation of the countryside.

Noise must be kept to a reasonable level at all times so as not to disturb the enjoyment of others.
– All sites are closed to traffic from 9pm to 7am during which time noise should be kept to a minimum and a quiet period observed for the benefit of all guests.

Fires

Open fires are not permitted on the ground. Wood and any form of firelogs are permitted to be burnt in a fire pit or similar raised off the ground. BBQs may be used but must be raised off the ground and used with charcoal only. A £50 fee will be charged for burnt grass and guests burning wood will be asked to leave. In times of very dry weather, when the fire risk is high, the use of barbecues may be restricted.

Waste water

Waste water must be emptied into the disposal points provided. All toilet waste must be disposed of in the chemical waste disposal points provided, using water from that source.
– To avoid possible damage to sewerage systems we support the use of bio-degradable chemical fluids that do not affect the natural bacterial balance within the system.

Refuse disposal

Refuse must be placed in the correct recycling receptacles provided. We dispose of every day waste but this does not include awnings, BBQ’s, chairs, tents, gazebos, carpets, mattresses and other large items – please take such items home with you. Any large items left on-site will be subject to an additional disposal charge of £20 per item.

Any cause for complaint must in the first instance be addressed with a member of the holiday site team. If in the unlikely event that the complaint cannot be resolved on site then it should be addressed for the attention of the Customer Services Team,
